How long does it take to settle an injury claim?
The time it takes to settle an injury case depends on many things, including:
1. Whether there is a question about who caused the accident. Most cases can be settled if it is clear who caused the accident. In a case where there is a dispute about causation it is far more likely that the case will have to go to trial.
2. The amount and type of insurance that each person in the accident has. If there is only minimal insurance or minimal damage, the insurance company may want to settle quickly to avoid the costs of defense. If there are extensive injuries and substantial insurance, the insurance company will be more likely to resist settlement because more is at stake.
3. How serious the injuries are. If the injuries heal completely and quickly, it may not take much time to reach a settlement. If the injuries are more severe, it is important not to settle until the injuries have either healed or until the treating doctor is able to confidently diagnose how bad the injuries are and how permanent they will be.
4. How clear it is that the accident caused the injuries. Sometimes an injured person had a similar injury before the accident. In that event may be hard to determine how much of his current injuries are new and how much they are from his old accident.
